The FDA is aware the FDA has raised concerns about THC products containing delta-8. FDA has not reviewed or approved these products for safe usage in any circumstance. Concerns include product labeling and product formulations being inconsistent. There may also be another cannabinoid/terpene content and different delta-8 THC concentrations. These products might be called “hemp products,” misleading consumers who associate “hemp” with “non-psychoactive.” Additionally, there is a growing number of products containing delta-8 THC that are being sold for therapeutic or medicinal purposes. Unapproved products that claim to have therapeutic benefits are illegal and can pose a danger to consumers. FDA is aware media reports that delta-8 cannabis products get people “high.” FDA is also concerned that delta-8 marijuana products could expose them to more THC than are found naturally in hemp extracts. This is why it is not possible to rely on the history of cannabis for determining safety.

4. Delta-8 THC Products Are Often Made With Potentially Hazardous Chemicals To Achieve The Levels Of THC Claimed On The Market.
